Use of Tobacco
Products on Town Property
WHEREAS Section 101.123 of the Statutes of the State of Wisconsin,
commonly known as the Clean Indoor Act, prohibits smoking in public
buildings except in those area specifically designated as "smoking
permitted areas", and
WHEREAS the Clean Indoor Air Law does not require the Town of Hiles to
designate smoking areas in buildings owned or leased by the Town of Hiles,
WHEREAS according to the Wisconsin Division of Health, smoking is the
single most preventable cause of death, and
WHEREAS local government has a responsibility to protect the health,
welfare, and safety of its employees and the general public,
NOW THEREFORE IT IS HEREBY RESOLVED BY
THE TOWN BOARD OF SUPERVISORS OF THE TOWN OF HILES AS FOLLOWS:
SECTION 1: Intent
The Town of Hiles finds and concludes
that tobacco use contributes to health problems, both directly through the
use of tobacco products and indirectly to non-tobacco users through
involuntary inhalation of tobacco smoke. Accordingly, the Town of Hiles
finds it is necessary to protect the health, welfare, safety, and comfort
of the public and this resolution in enacted in furtherance of that goal
and the goal of reducing the health risks associated with tobacco use in
Town of Hiles buildings and property which are either owned or leased by
the Town of Hiles.
SECTION 2: Definitions
"Tobacco Products" has the meaning given in Section 139.75(12), Wis.
Stats. And includes the following: cigarettes, cigars, snuff, chewing
tobaccos, and other kinds of tobacco suitable for chewing and/or smoking
in a pipe.
"Use of Tobacco Products" means smoking, carrying or possessing a lighted
tobacco product, chewing tobacco, or otherwise using a tobacco product for
its intended purpose.
"Town Buildings and Property" means any enclosed building or property
owned or leased by the Town of Hiles. This definition includes, but is not
limited to the Town Hall, Town Shop, Fire Department locations, and Town
owned or leased vehicles and any and all other enclosed building owned or
leased by the Town of Hiles.
SECTION 3: Tobacco Use
It shall be unlawful and a violation of
this section for any person, whether employed by the Town of Hiles, an
elected official, or a member of the public, to use tobacco products in
any Town building or property defined herein.
SECTION 4: Effective Date
The policies described in this resolution
shall be effective on August 1, 2000.
